If you own a home in Encinitas and want to rent it on Airbnb or VRBO, you need a permit before your first guest checks in. The good news is that Encinitas is one of the more permit-friendly coastal cities in San Diego County. Here is everything you need to know to get compliant in 2026.

Do I Need a Permit to Rent My Encinitas Home?

Yes. Any single-family home or duplex rented for 30 consecutive days or less requires a Short-Term Rental (STR) Permit from the City of Encinitas. Operating without one can result in fines and penalties. As of 2026, only about 25% of active Encinitas short-term rental listings are fully compliant — meaning the majority of hosts are operating at risk. Getting permitted puts you in a much stronger position.

Who Qualifies?

Short-term rentals are allowed in single-family homes and duplexes in all residential zones. They are not permitted in multi-family dwellings such as apartments or condominiums, or in newly constructed ADUs (accessory dwelling units). Your property must also be privately owned.

How to Apply

Applications are submitted online through the City of Encinitas Customer Self-Service (CSS) Portal. You will need to gather the following before you apply:

A grant deed or proof of ownership, your contact information and the contact details of a local 24/7 emergency contact person, the number of bedrooms and on-site parking spaces at the property, and documentation confirming you have smoke detectors, carbon monoxide detectors, and a fire extinguisher installed.

All owners listed on the property deed must sign the application. If the property is held in a trust or LLC, the trustee or general member must sign.

How Much Does it Cost?

The permit fee is $425 per year, non-refundable. You also need to register your business with the city, which costs $39 for new registrations and $24 for renewals. Permits must be renewed every 12 months.

Occupancy and Operational Rules

Once permitted, here are the key rules you need to follow. The maximum overnight occupancy is two guests per bedroom plus one additional guest per dwelling. Non-hosted rentals (where you are not present during the stay) require a minimum stay of three consecutive nights. Your property must maintain $1 million in short-term rental liability insurance at all times — if your insurance lapses, your permit is automatically revoked. Non-hosted rentals must also be at least 200 feet apart from other non-hosted STRs to prevent neighborhood oversaturation.

Transient Occupancy Tax (TOT)

Encinitas charges a 10% Transient Occupancy Tax on all short-term rental income. Unlike some other cities, Airbnb and VRBO do not collect and remit this tax on your behalf in Encinitas. That means you are responsible for collecting it from guests and submitting it to the city quarterly. Missing TOT payments can result in your permit being suspended.

The 2026 Coastal Commission Update

In February 2026, the California Coastal Commission approved updated short-term rental regulations for Encinitas. Hosted STRs (where you live on the property at least half the year) are not subject to a permit cap. Non-hosted STRs are subject to a citywide cap of 2.5% of total housing units, with a higher cap of 4% in the Coastal Zone.
